Terms of Service

These Terms of Service ("Terms") govern your access to and use of the planet124.com website and services (the "Service"). The Service is operated by planet124.com ("planet124.com," "we," "us," or "our"). By creating an account, browsing the marketplace, posting a listing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) and legally able to enter into binding contracts to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. To create an account, you must complete sign-up through our authentication system; we do not accept password-based account creation for ads posted by non-members.

planet124.com is a listing and discovery platform only. We provide tools for sellers to post products and classified ads, and for buyers to find and contact sellers. We are not a party to any transaction between buyers and sellers, and we do not take possession of, inspect, or guarantee any item. All transactions — including payment, shipping, delivery, and returns — are arranged and completed directly between the buyer and the seller. We are not responsible for disputes that arise between buyers and sellers.

Sellers may list products on the Service by maintaining an active monthly subscription. The current subscription price is $5.00 USD per month, billed through our payment provider (PayPal). Subscription fees are non-refundable except where required by law. We do not charge a commission on sales — sellers keep 100% of their proceeds. Selling additional subscription capacity may be purchased from the seller dashboard. We may change subscription fees upon reasonable notice; continued use after a change constitutes acceptance of the new fee.

Classified ads are posted for a flat fee per ad and remain active for 30 days from the date of posting. Because classified ad fees are collected at the time of posting to cover hosting and review costs, ad posting fees are non-refundable, including for ads that are removed for violating these Terms or our policies. Ad content must be accurate and may not violate any law or the rules referenced in these Terms.

You agree not to use the Service to list, sell, or promote any illegal, counterfeit, stolen, dangerous, or prohibited item, or to engage in fraud, deception, or harassment. Prohibited conduct and items are described in detail in our Illegal Products Prohibited and Fraud Policy pages. Fraudulent activity will result in permanent ban from the Service without refund. Sellers must provide accurate product descriptions and real photos, manage inventory honestly, and price items truthfully, as outlined in our product description, photos, inventory, and pricing rules.

You retain ownership of content you submit (such as product listings, images, and messages), but you grant planet124.com a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Service. You represent that you own or have the rights to all content you submit and that it does not infringe the rights of any third party. We may remove, decline, or edit any listing at our discretion, including listings that are inaccurate, misleading, or that violate these Terms.

We respect intellectual property rights and will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a written notice to marketplace@planet124.com including: (a) identification of the copyrighted work, (b) identification of the infringing material and its location on the Service, (c) your contact information, (d) a statement that you have a good-faith belief that the use is not authorized, and (e) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act. We will remove infringing material upon a valid notice. Repeat infringers will have their accounts terminated.

Sellers may be subject to verification and admin approval before listings go live. Verification does not constitute an endorsement by planet124.com, and we make no representation about the trustworthiness, quality, or reliability of any seller. Buyers are encouraged to perform their own due diligence before transacting, as described on our Due Diligence page.

Seller subscription payments and classified ad posting fees are processed by our third-party payment provider (PayPal). We do not store your full payment card details. By submitting payment, you authorize the payment provider to charge the applicable fees. Disputes about subscription billing should be directed to us; disputes about a purchase from a seller must be directed to that seller (and, where applicable, to the payment provider you used to pay the seller).

You may not use the Service for any unlawful purpose, to violate any law, or to facilitate fraud. Prohibited conduct is detailed in our Fraud Policy and Illegal Products Prohibited pages. We reserve the right to suspend or terminate any account, remove any listing, and report conduct to law enforcement. Email spam or harassment is prohibited per our No Spam or Harassment policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LISTING, SELLER, OR ITEM IS ACCURATE, LAWFUL, OR AS DESCRIBED. WE ARE NOT RESPONSIBLE FOR DISPUTES BETWEEN BUYERS AND SELLERS, as further described on our disputes and transactions pages.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PLANET124.COM NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless planet124.com and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, your infringement of third-party rights, or your dealings with other users.

We may suspend, restrict, or terminate your account and remove any listing at any time, with or without cause or notice, including for violation of these Terms or our policies. You may cancel your seller subscription at any time from the seller dashboard; cancellation stops future billing but does not refund the current period. On termination, your right to use the Service ends immediately.

Our handling of personal data is described in our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which planet124.com is organized, without regard to conflict-of-law principles. You and we agree to attempt to resolve any dispute informally first. Any claim or dispute that cannot be resolved informally shall be resolved by binding arbitration (and not in court), except that either party may bring a small-claims court action. You waive any right to participate in a class action or class-wide arbitration.

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If a change is material, we will provide additional notice where feasible.
